Middle Hill Tenure Review - Notice of Preliminary Proposal

Public submissions are being sought on the Preliminary Proposal for Middle Hill pastoral lease tenure review. Submissions close 16 July 2012.
NOTICE IS GIVEN under Section 43 of the Crown Pastoral Land Act (CPLA) 1998 by the Commissioner of Crown Lands that he has put a preliminary proposal for tenure review to Richard Jeremy King and Julia Jane King as lessees of Middle Hill pastoral lease.

Pastoral lease land
Run 223, Puhi Puhi Survey District being all the land contained in Instrument of Title MB 62/19 (Marlborough Land Registry) comprising 3,217.6555 hectares more or less.
Crown Land
Crown Land (old Clarence River flood channel) subject to the Land Act 1948 comprising 13.0000 hectares approximately.
General description of proposal
- An area of Unused Crown Land of approximately 5 hectares to be designated as land to be restored to or retained in full Crown ownership and control, under Section 35(2)(a)(iii) Crown Pastoral Land Act 1998.
- An area of approximately 2,678 hectares to be designated as land to be restored to or retained in Crown control, as conservation area, under Section 35(2)(b)(i) Crown Pastoral Land Act 1998 subject to:
Qualified Designation:A 10 year tourism concession with no right of renewal under Section 36(1)(a) Crown Pastoral Land Act 1998 granted to Richard Jeremy King and Julia Jane King to provide the continuation of the current tourism activities undertaken on the pastoral lease of conduct of guided hunting, guided tramping, and 4WD touring.Qualified Designation:A 15 year grazing concession with no right of renewal under Section 36(1)(a) Crown Pastoral Land Act 1998 to be granted to Richard Jeremy King and Julia Jane King.Qualified Designation:An easement concession in perpetuity under Section 36(1)(a) Crown Pastoral Land Act 1998 to be granted to Richard Jeremy King and Julia Jane King for farm management, stock access and tourism operation purposes. - An area of 535 hectares approximately to be designated as land to be disposed of by freehold disposal to Richard Jeremy King and Julia Jane King under Section 35(3) Crown Pastoral Land Act 1998 subject to:
Protective Mechanism:A conservation covenant under Section 40(1)(b) and Section 40(2)(a) Crown Pastoral Land Act 1998 over approximately 43 hectares to protect the natural values.Qualified Designation:An easement under Section 36(3) Crown Pastoral Land Act 1998 to provide access for tenants, agents, contractors, licensees, invitees and employees of the Minister of Conservation and the Director-General of Conservation on foot, or on or accompanied by horses, or by non-motorised vehicle powered by a person or persons or by motor vehicle, with or without machinery and implements of any kind, and with or without guns and dogs, for management purposes.
- An area of Unused Crown Land of approximately 13 hectares to be designated as land to be disposed of by freehold disposal to Richard Jeremy King and Julia Jane King under Section 35(3) Crown Pastoral Land Act 1998.

Submissions
Any person or organisation may send a written submission on the above proposal to the Commissioner of Crown Lands, C/- Darroch Ltd at the above address.
All submissions are being collected and held by LINZ either directly or through its contractor.
Submitters should note that all written submissions may be made available, in full, by LINZ to its employees and contractor, the Department of Conservation and the public generally.
Closing date of submissions
Written submissions must be received by the Commissioner’s contractor no later than 5pm Monday 16 July 2012.
