Crown Pastoral Management

LINZ looks after approximately 3.3 million hectares of Crown land made up of:

  • pastoral leases. In 1998 LINZ administered 306 pastoral leases in the South Island of New Zealand. That number is falling due to Tenure Review. Pastoral leaseholders are generally farmers who have a lease with a perpetual right of renewal. Leases allow grazing of the land for pastoral farming purposes. Leaseholders are subject to a range of restrictions on other use of the land
  • special leases. These are leases that are created for a special purpose that allow grazing of the land for pastoral farming purposes. Leaseholders are subject to a range of restrictions on other use of the land
  • pastoral occupation licenses (POLs). POLs give the licensee fixed term use of pastoral land subject to a range of conditions. The conditions are generally more restrictive than pastoral leases.

No new pastoral leases are available.

What's available

Crown Pastoral Land Consent Process

LINZ considers requests from leaseholders for approval to carry out activities where Crown approval is needed under the lease or licence. This includes activities such as the transfer of the lease to another party, undertaking activities on the land for farming purposes (e.g. cultivation, tracking or burning) or to use the land for commercial recreational purposes.

Any application for consent needs to be on the correct application form and the completed forms can be forwarded to the LINZ Pastoral Unit along with any questions on this process or application. Further information on the consent process itself is available by looking at the relevant Crown Pastoral Land Standard.

Rent Reviews

The amount of yearly rent payable under a pastoral lease is calculated as a percentage of the Land Exclusive of Improvement (LEI) value. This is reviewed in accordance with the provisions of the Land Act and the Crown Pastoral Land Act, every eleven years. The LEI value is assessed by valuers in accordance with New Zealand Institute of Valuers Standards, relevant LINZ standards, legislation and case law.

The leaseholder has the right to either accept the resulting proposed annual rental, or to elect to have the values fixed in the Land Valuation Tribunal.

In May 2007, LINZ notified new and revised rents that reflect land market movements during the previous 11 year rental period and amenity values - which include inherent and locational values and natural characteristics - if present on a property. Tenure Review

Tenure Review is the process leaseholders must go through to gain ownership of pastoral leasehold lands under the Crown Pastoral Land Act 1998. Once they have freehold ownership of land they may use it like any other NZ landowner. Each tenure review follows the same process but may have different results. In some cases all the land of a particular lease may be proposed for conservation. In others, all the land may be freeholded to the leaseholder.

Review of Other South Island High Country land

LINZ is required to undertake reviews of land held under limited term pastoral occupation licence and may undertake a review of any unused Crown pastoral land. The Review of Other South Island High Country land process decides what Crown-owned land may be freeholded, and what should be returned to full Crown ownership.

Exclusive possession of pastoral lease land

LINZ sought advice from Crown Law regarding the right of pastoral leaseholders to exclusive possession of leasehold land. The Crown Law opinion is available here.

LINZ's role

LINZ's Crown Property Management group, under delegation from the Commissioner of Crown Lands (CCL), undertakes the day-to-day management of the Crown's interest in pastoral land, including pastoral leases, special leases, pastoral occupation licences, recreation permits and any other interests granted in respect of Crown Pastoral Land vested in Her Majesty the Queen in right of New Zealand.
