Soldiers Syndicate Review of Crown Land - Notice of Preliminary Proposal

2 November 2010

Public notice: Notice is given under section 43 of the Crown Pastoral Land Act 1998 by the Commissioner of Crown Lands that he has devised a revised Preliminary Proposal for the review of Crown land pursuant to section 86 of the Crown Pastoral Land Act 1998 previously held in the Soldiers Syndicate occupation licence comprised and described in Computer Interest Register 7657 (Otago Registry).

A Preliminary Proposal for this Crown land was advertised on 20/10/2007 which designated the land to be restored to or retained in full Crown ownership and control as conservation area.

86 public submissions and one iwi submission were received. However, analysis was not completed due to proceedings taken against the Commissioner of Crown Lands.

As a result of proceedings in the High Court in Christchurch, the Hon Justice French on 30 October 2008 directed that the Preliminary Proposal be revised to reflect an earlier decision of the Commissioner of Crown Lands. That decision was that the land be designated suitable for disposal by special lease pursuant to section 86 (5) (b) (i) Crown Pastoral Land Act 1998.

Legal description of land concerned

Part Run 573 Mt Buster Survey District, Block III Naseby Survey District and Block II Kyeburn Survey District. 4450 hectares (more or less).

General description of the proposal

That the land described above be designated as suitable for disposal by special lease pursuant to section 86(5) (b) (i) Crown Pastoral Land Act 1998 on terms specified in the proposal.
