Schedule of Application Fees

Fees vary according to the type of application and whether the decision will be made by the relevant Minister or the Overseas Investment Office (OIO). Here the OIO reproduces all the fees as detailed in Schedule 2 of the Overseas Investment Regulations 2005, including administrative and other fees.

Quick information on fees

Fees are determined by the nature of the application and whether the decision is ministerial or delegated. Read the Ministers' current Designation and Delegation Letter (pdf 1.1MB).

The majority of applications fall under either:

  • consent for a land transaction determined by the relevant Minister - $22,000 or
  • consent for a land transaction determined by the regulator (OIO) under delegation - $19,100 or
  • consent for significant business assets transaction determined by the Regulator under delegation - $12,900.

If consent to more than one of the above is being sought simultaneously, for example an acquisition of significant business assets which includes the acquisition of sensitive land, then the fee for the land decision applies - $22,000/$19,100. Please note that where a land decision is also a business decision, provided the land is urban and does not include special land, then that decision will be determined by the Regulator under delegation.

How do I know who will determine consent?

About application fees

Fees and charges (see Regulation 29 of the Overseas Investment Regulations 2005) are detailed in Schedule 2 of the Regulations. Fees are inclusive of Goods and Service Tax (GST). In order to determine the appropriate fee, you must first determine:

An application will not be processed unless it is accompanied by the correct fee. Neither the regulator nor the relevant Ministers can grant consent without the application fee first being paid. The OIO does not have the power to refund application fees.

Part 1: Land applications
