These questions and answers relate to survey boundaries and the new Rules for Cadastral Survey 2010. Other questions and answers on the new Rules are also available.

- Where upper or lower unit boundaries are stratum boundaries defined by reduced levels, must the PRMs, witness marks and vectors be electronically captured?
- All the survey marks and vectors must be electronically captured in a dataset type Standard Unit Plan with survey sheet. It is not sufficient to show the mark and vector information only on a plan graphic or on a field note (rule 7.3.1(b); rule 9.6.10). The Diagram of Survey will therefore include an aspatial plan graphic of the units plus an additional spatial survey plan diagram generated in Landonline of the marks and vectors.
- In a unit development, should the CSD show upper and lower height limits in the schedule of entitlements where the boundary is related to a permanent structure, eg a mid floor unit within a high rise building with a lower boundary that is 0.10m below the finished floor level?
- Where the boundary is a permanent structure boundary, eg the boundary is described as 0.10m below concrete floor, the CSD must not show a reduced level for this boundary, and must not show upper and lower limits in the entitlement schedule.
Reduced levels are used for stratum boundaries only.
A stratum boundary may be used for describing the lower limit of a unit, but in this case, the boundary must not then be described as 0.10m below concrete floor.
Where a CSD shows both forms of boundary, it will be a failure of rules 9.6.15(a) and 10.4.10(a).
- In the case of permanent structure boundaries where the building is within 1m of the underlying boundary, can the dataset type be Standard Unit Plan with the structure location and clearances shown on a field note supporting document?
- Where the distance is less than 1m, rule 9.6.9(b) requires the Diagram of Survey to include the distance between the permanent structure boundary and the underlying parcel boundary. This can be shown on the same aspatial plan graphic that depicts the units. Field note supporting documents do not form part of the Diagram of Survey so would not satisfy the rule requirement.
The Rules do not require the survey traverse and ties to the building to be part of the CSD, although this information can be included if the surveyor chooses. Where this information is included in an aspatial plan graphic or as a supporting document, the dataset type will be a Standard Unit Plan.
- Will unit plans still use plan graphics?
- Yes, the Diagram of Survey will include an aspatial plan graphic of the units. Where there is a stratum boundary, there will also be an additional spatial survey plan diagram generated in Landonline of the heighted witness marks, PRMs and vectors.
- Are the boundaries of an underlying primary parcel under 0.4ha required to be defined by survey where there is to be a unit development?
- Normally the boundaries will be able to be defined by adoption. However if a unit boundary is within 1 m of the primary parcel boundary and the relationship between the two boundaries cannot be accurately obtained (refer to rule 3.5) then the primary parcel boundary may need to be defined by survey.
