Claims for Compensation

You may be able to claim compensation from the Registrar-General of Land if you have incurred a financial loss or have been deprived of any land, or an interest in land, due to an error or other inappropriate action on the part of LINZ in carrying out the requirements of the Land Transfer Act 1952.

The Registrar-General of Land investigates claims and is required by the Land Transfer Act to refer them to the Attorney-General for a joint decision on whether to accept the claim.

If the Registrar-General of Land and the Attorney-General are satisfied that a claim is well founded, the Registrar-General will pay compensation. If the Registrar-General of Land and the Attorney-General refuse a claim, the claimant can still make an application to the Court if the claimant considers that the claim is justified.

Examples where you may be entitled to make a claim are a loss in value of property, due to the omission from the Register of an interest or restriction, or the loss of the property itself, due to fraudulent action by a third party resulting in some other person becoming registered as the owner.
