Summary

The Land Transfer Act 1952 (LTA) requires the particulars of estates and interests to be entered on affected titles in the form of memorials upon registration. The priority of registered estates and interests is generally established by the date and time of lodgement.

Requirements for specific notations for other purposes also arise under other legislation.

The purpose of this standard is to ensure that transactions are completely and accurately entered and maintained in the Register in accordance with statutory requirements.

This standard complements and expands on the memorial requirements already prescribed in the LTA and other legislation.

Any person with delegated authority under section 5 of the LTA must comply with this standard when performing registration functions.

Please note an amendment to the standard was published on 27 November 2007 and must be read with this document (link below).
