Authority and Identity Requirements and Electronic Signing of Documents Interim Guideline 2020 - 30 March 2020
This interim guideline is intended as a guide to how practitioners may meet LINZ requirements while COVID-19 restrictions apply.
The guideline continues to have effect until it is revoked, and notice of its revocation is published on the LINZ website. LINZ will endeavour to provide 2 weeks notice to the profession prior to revocation.
We are also reviewing the Authority and Identity Requirements for E-Dealing Guideline 2018 – LINZG20775, and considering what of the interim guidance can be adopted more permanently.
Completing statutory declarations remotely
LINZ will accept statutory declarations completed in accordance with the following protocols:
Landonline e-dealing Compliance Reviews and Law Firm Audits during COVID-19
As we all tackle the challenges presented by Covid-19 and changing alert levels, we have reviewed our approach to e-dealing Compliance Reviews and Law Firm Audits at the different alert levels.
Signing documents remotely
A summary of our existing guidance regarding signing documents remotely and how we’ve modified that guidance to deal with COVID-19 restrictions.
Enduring powers of attorney
LINZ will accept documents signed under an enduring power of attorney completed remotely in accordance with the Epidemic Preparedness (Protection of Personal and Property Rights Act 1988 - Enduring Powers of Attorney) Immediate Modification Order 2020.

Withholding land ownership details
At COVID-19 Alert Levels 2 and 3, an application to withhold information requires a statutory declaration from the applicant. The statutory declaration may be made remotely.

During COVID-19 Alert Levels 2 and 3, licence restrictions were disabled for Landonline accounts that have already purchased Landonline licences. We are reviewing the requirement for licences so have left this measure in place pending a decision on licensing going forward. In the interim, each Landonline account may continue to operate with 100 additional licences of the same type already purchased at no cost.
Titles Registration Services
Electronic Lodgement and Processing of dealings is all fully available.
Cadastral Survey Dataset approval
Cadastral Survey dataset processing is fully available.
Limited services are available from Archives NZ. Deeds Indexes are available online via Archives Archway platform.
Access to manual records
Access is available to LINZ documents stored on and off site but some delays are expected.
Lapsing of caveats
We will endeavour to serve notices under s143(2) LTA 2017 within usual processing timeframes.
Notices to Mariners
The New Zealand Hydrographic Authority is prioritising safety critical maritime information throughout the COVID-19 Restricted Alert periods. Safety critical information is provided through the normal channels including Radio Warnings, NAVAREA XIV Broadcasts and NtMs.

During the COVID-19 Restricted Alert periods, charts will be available through normal channels. Please note some chart retailers may not be open for business at this time.
LINZ camping areas remain open to allow people to enjoy these areas as rest stops, for recreation purposes, or camping.
Toilet facilities at our sites are also open and being cleaned daily.
Please follow the Government’s COVID-19 Alert Level guidelines, including practicing social distancing if visiting our camping areas and staying home if you are feeling unwell.
We ask visitors to please leave the facilities clean and tidy for other users and follow good hygiene practices.
Our boat ramps are also open for use.
LINZ continues to prepare for the spring/summer pastoral lease inspection programme.
During Alert Level 2, pastoral lease visits will be restricted to essential work only. During visits, our team and contractors will adhere to the Government’s Alert Level 2 guidelines, including practicing social distancing.

Biosecurity and Biodiversity
LINZ biosecurity control works will continue under Alert Level 2 (outside of the Auckland region). Existing and new contractors are required to demonstrate full compliance with government guidelines for working under Alert Level 2 prior to undertaking any works.
Landbank and LINZ properties (Demolition & hazard management related)
Contractors operating on LINZ-managed sites will continue to work during COVID-19 Alert Level 2 (outside of the Auckland region) where projects are able to proceed. As previously demonstrated, contractors will strictly adhere to the Government’s Alert Level 2 guidelines and can practice social distancing.
Contractors operating on Crown-owned Port Hills red zone and Central Business District land in Christchurch will continue work during COVID-19 Alert Level 2 where projects are able to proceed, and the contractor has demonstrated they can strictly adhere to the Government’s Alert Level 2 guidelines and can practice social distancing. This includes maintenance contractors for the Port Hills residential red zones. Any enquiries about flat land residential red zone land should be directed to Christchurch City Council.
We are continuing to implement the September 2019 Global Settlement Agreement, including reconfiguring red zone land to hand over to Christchurch City Council. As part of this work, physical, on-the-ground surveying is able to take place during COVID-19 Level 2, in line with Government guidelines.
We are working with Christchurch City Council and applicants to consider all transitional land use requests as quickly as possible. Any access to transitional land use sites for essential activities must be referred to LINZ in the first instance: email@example.com.
To assist with the delivery of central city anchor projects, we’re well-prepared to proceed with physical works – including management and demolition – subject to appropriate controls to meet health and safety and COVID-19 requirements.
Overseas Investment Office
The Overseas Investment Office continues to operate. This includes accepting new, and progressing existing, applications.
Assessors continue to contact investors and legal advisors to understand the impact COVID-19 might have on proposed investments. We also encourage investors and their advisors to let us know if their client’s investment situation has changed, if there is going to be an application delay or if they require an application to be fast-tracked. Pre-application meetings can still occur online.
Site visits are currently on hold due to COVID-19 safety requirements. We encourage existing consent holders to get in touch with us if the impacts of COVID-19 will prevent them from complying with their consent conditions.
