If a non-navigable river or stream dries up (for example, because it has changed course suddenly and perceptibly), an application to bring land under the Act may be made.
This guideline explains how a landowner may apply to bring former river or stream bed under the provisions of the Land Transfer Act 2017. It outlines the factual and legal requirements necessary to fulfil the mandatory requirements for such applications in the Boundary Changes − Accretion and Dry Beds (Rivers and Streams) Standard 2018 – LINZS20013.
Note: This guideline was updated on 28 May 2020 and supercedes all earlier versions. It contains amendments to section 1.4:
- The reference to “r25” now reads “r27”.
- The reference to “60 working days” now reads “40 working days”.
