Examples of activities allowed on Crown lands and properties we manage, application forms and types of agreements.

The table below is a guide to help you select what type of application to make.

Each application will be assessed and a decision will be made based on its merits.

If your application is approved, the agreement you get may differ from the one you apply for.

This is because our assessment may find that an alternative is more suitable for your activity.

Beautification and biosecurity

Examples of activities to enhance (beautification) or protect (biosecurity) nature are:

  • community gardens
  • native plant restoration
  • beehives
  • pest and weed control.

Some biosecurity work is contracted by Toitū Te Whenua to external providers.

Others wanting to do biosecurity work need to apply for access.

Lease, licence or access application form

Commercial property

 

People who want to occupy Crown properties for commercial activities will need a lease or licence.

The nature of ownership will determine what type of lease or licence is needed. In some cases, the Crown owns the land but not the building, or vice versa.

Lakebeds and riverbeds

People who want to do an activity within a Crown-owned lakebed or riverbed will need a licence.

Examples of activities are:

  • building a jetty or boat mooring
  • anchoring swimming pontoons
  • extracting gravel.

MiningCompanies/individuals with a mining permit from NZ Petroleum and Minerals can apply for access to operate on Crown land.Mining application form
Recreation

People who want to do recreation activities on Crown land will need a permit.

Examples of activities are:

  • adventure sports, such as heli-skiing and mountain biking
  • events, such as music festivals and adventure races
  • filming
  • hiking and trekking
  • hunting
  • mobile trading
  • tourism, such as 4 wheel drive tours and farm stays/glamping
  • water activities.

Types of agreements

AgreementWhat it providesMore information
Access arrangementGives access to the land for exploration and other mining activities.Applicants must have a mining permit from NZ Petroleum and Minerals.
Access letterGives access to Crown land for a short duration for activities that are low risk and low impact.We'll be in contact to discuss if this type of agreement is appropriate for your activity.
Commercial recreation permitGives the right to use the land for recreation purposes and a specific period of time.

  • adventure sports, such as heli-skiing and mountain biking
  • events, such as music festivals and adventure races

  • tourism, such as 4 wheel drive tours and farm stays/glamping
  • water activities.
Easement

Gives the right to use Crown land for a particular purpose and longer duration.

Can be registered against the property’s title.

Examples of activities needing an easement are: 

  • public access, such as for walking and cycling
  • draining water and sewage 
  • moving (conveying) items for utilities like water, gas, petroleum, electricity, telecommunications and internet provision
  • establishing a right of way.
LeaseGives the right to occupy the land or property over a longer-term.

Gives exclusive use.

Lease agreements may include rights of renewal and provisions for reviewing the rent over the term of the lease – see Sublease, sublicence or transfer.

LicenceGives the right to occupy the land or property for a particular purpose for the short to medium-term.Is not exclusive.
