Decision
What the decision relates to
Clearing scrub
Duration of consent
10 years
Reasons for decision
For the part of the consent that was granted
The Commissioner of Crown Lands has determined that granting consent to clear scrub has positive farming benefits that outweigh negative impacts on inherent values that it is desirable to protect. Conditions have been imposed to ensure that the inherent values associated with wetlands and the associated shrublands which include inherent values that the Commissioner wishes to protect are maintained.
For the part of the consent that was declined
The Commissioner of Crown Lands has determined that these blocks contain inherent values relating to shrublands, wetland and landscape inherent values that he wishes to protect.
Conditions of decision
Consent is granted in part for clear scrub, subject to the following conditions:
- Scrub is not to be cleared from within wetlands, seepages and watercourses including a minimum riparian margin of 10 metres; and
- Consented sediment traps within close proximity of the approved area are installed prior to works beginning.
- Root raking is to occur across slope to reduce the risk of soil erosion; and
- Disturbed areas are to be revegetated as soon as possible (not exceeding 3 months) following the clearance and maintained with adequate fertiliser; and
- Burning is confined to the burning of windrows of cleared scrub within the cleared areas; and
- Any consents or permits required from the Southland District Council, Environment Southland and Fire and Emergency New Zealand are obtained prior to work commencing.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
