Reasons for decision
The Commissioner of Crown Lands has determined that the proposed activity is one which comes within the provisions of section 66A of the Land Act 1948 and that the terms and conditions specified in the attached permit will minimise any potential adverse effects of the proposed activities to be no more than minor.
Conditions of decision
Consent is granted for use of station tracks and existing accommodation and facilities in association with horse trekking, mountain biking, four-wheel driving, tramping, fishing and filming, subject to the following conditions:
- Not remove any vegetation, disturb any soil or light any fire on the Operational Area.
- Not at any time cause any building, erection, structure or fence or alteration or addition thereto to be placed or carried out upon the Operational Area.
- Comply at all times with all statutes and regulations and obtain all approvals, consents and authorisations as are necessary for the Grantee to conduct the activities permitted by this Permit.
- Remove and take away or cause to be removed and taken away all refuse.
- Comply with the provisions of the Health and Safety at Work Act 2015 (and if applicable, the Health and Safety at Work (Adventure Activities) Regulations 2016) and any Act in substitution thereof and any regulations thereunder.
- Ensure that the activities authorised by this permit will be confined exclusively to the Operational Area and use the Operational Area solely for the activities authorised by this permit.
- Take all reasonable precautions to guard against danger on the Grantor’s land.
- Not interfere or obstruct the Grantor or his/her agent’s employees or contractors or authorised invitees.
- Comply at all times with the provisions of the Biosecurity Act 1993 and the Biosecurity New Zealand guidelines, including compliance with guidelines for limiting the spread of Didymo (Didymosphenia geminate) published by the Ministry of Primary Industries at https://www.mpi.govt.nz/outdoor-activities/boating-and-watersports-tips-to-prevent-spread-of-pests/check-clean-dry/.
- Ensure clients use existing toilet facilities at the accommodation or other huts.
- Use only the constructed tracks on the land as defined on in the attached plans for all vehicles and mountain bikes and not construct new tracks without the prior written consent of the Grantor.
- Restrict horse trekking routes to existing tracks.
- Monitor the environmental effects of the permitted activity on the physical environment and take active steps to ameliorate any adverse effects.
- Meet all obligations under the Fire and Emergency New Zealand (FENZ) Act 2017, including ensuring that FENZ is notified if a fire is getting out of control or spreading, and taking reasonable steps to reduce the likelihood of harm or damage if you discover a burning or smouldering substance or an ensuing fire.
- Hold and maintain a comprehensive Health & Safety Plan which addresses hazards and risks associated with operating the activity.
- Implement a log book system for all recreational activities described in the First Schedule and include duration of trips, names of clients and times they are due back at the station homestead.
- Operate the activities authorised by this permit in a professional, safe, reputable manner in accordance with industry standards, if any.
Recreation permits granted by the Commissioner of Crown Lands also incorporate (with minor variations) the terms set out in Appendix H of the the Standard for purchase, alienation, and administration of Crown land - LINZS45002.
