Reasons for decision
The CCL has determined that the proposed activity is one which comes within the provisions of section 66A of the Land Act 1948 and that the terms and conditions specified in the attached permit will minimise any potential effects from the proposed activity. As a result, the adverse effects on the inherent values have been determined to be no more than minor. The amendments to the permit document are to comply with the requirements of LINZS45002.
Conditions of decision
Consent is granted for the recreation permit, subject to the following conditions:
- Not remove any vegetation, disturb any soil or light any fire on the Operational Area.
- Not at any time cause any building, erection, structure or fence or alteration or addition thereto to be placed or carried out upon the Operational Area.
- Comply at all times with all statutes and regulations and obtain all approvals, consents and authorisations as are necessary for the Grantee to conduct the activities permitted by this permit.
- Remove and take away or cause to be removed and taken away all materials, structures, contaminants, human waste, refuse, vehicles, equipment and vegetation placed on the site for the purposes and activities set out in the First Schedule.
- Ensure that any damage or disturbance to the surface of the land as a result of the activities allowed by the Permit is restored to its former condition to the reasonable satisfaction of the Grantor and Lessee.
- Ensure that all vehicle use is kept to formed tracks, where possible, to avoid any damage/impact on soil and vegetation.
- Comply with the provisions of the Health and Safety at Work Act 2015.
- Ensure that the activities authorised by this Permit will be confined exclusively to the Operational Area and use the Operational Area solely for the activities authorised by this permit.
- Take all reasonable precautions to guard against danger on the Grantor’s land.
- Not to interfere or obstruct the Grantor or his/her agent’s employees or contractors or authorised invitees.
- Ensure all participants, officials, and support crews, comply at all times with the provisions of the Biosecurity Act 1993 and the Biosecurity New Zealand guidelines, including compliance with guidelines for limiting the spread of didymo (Didymosphenia geminata) and other freshwater pests as published by Biosecurity New Zealand – See ‘Check, Clean, Dry: preventing didymo and other pests | NZ Government (mpi.govt.nz)’. The MPI website must be regularly checked for updates on precautions accordingly.
- Take all reasonable precautions, in relation to any motor vehicle use to prevent the accidental starting of any fire, particularly at times of high fire risk.
- The ‘Environmental Care Code’ should be adhered to at all times.
- Ensure wetland areas are avoided at all times.
- Ensure all precautions necessary to ensure that weeds are not introduced to the Operational Area. This shall include, but not be limited to, ensuring that all tyres, pedals, footwear and packs, are clean of weeds, seeds and plant material prior to entering the Operational Area.
- Be aware that the Operational Area is subject to Part 4A Conservation Act 1987. Therefore, marginal strips may be present. Marginal strips are administered by the Department of Conservation and are excluded from this Permit. For the avoidance of doubt, ensure only essential crew access and/or be present in the Leaping Burn area, in line with this Permit and any other Department of Conservation authority or guidance on the use of marginal strips.
- Ensure fuel spill kits are to be available on site at all times, and trained crew available, and that any fuel or other chemical that poses a contamination risk, are stored in suitable containers, and kept at a distance of at least 100m from waterways.
- Any temporary structure(s) or soil disturbance as set out in the First Schedule, must avoid sites containing naturally rare vegetation including screes, seepages/flushes, and outwash terraces. Structures must avoid vegetation of national significance or of local importance, including any wetlands.
- Ensure any vehicles, including but not limited to, other equipment, or structures, used as props, or part of filming, should be clean and free of any weeds and/or exotic seeds, be kept as far from waterbodies as possible to get the necessary shots and be removed, as soon as possible, after filming. The installation of props, structures, must also avoid the introduction of any weed species and other exotic species of conservation concern, and must avoid rocky outcrops (rocky outcrops provide potential lizard habitat).
- Hold at all times a comprehensive Health & Safety Plan appropriate to the activities as set out in the First Schedule.
- Meet all obligations under the Fire and Emergency New Zealand (FENZ) Act2017, including ensuring that FENZ is notified if a fire is getting out of control or spreading, and taking reasonable steps to reduce the likelihood of harm or damage if you discover a burning or smouldering substance or an ensuing fire. For the avoidance of doubt, any activities that may have a potential fire risk associated to them, Fire and Emergency New Zealand (FENZ) must be engaged to ensure that the permissions and mitigation are in place to prevent the risk of fire.
- Ensure that neither historical artefacts, sites or resources, if present on or adjoining the Operational Area, are disturbed nor relics removed by the Grantee or any personnel, cast, crew, or contractors, in the Activities under this Permit.
- Ensure that all drone use complies with the Civil Aviation Authority (CAA) Rules Part 102 and that all drone operators hold recognised certifications.
- Be aware that the Operational Area may be over unformed legal road ‘Wanaka-Mount Aspiring Rd’. For the avoidance of doubt, these areas are excluded from this Permit.
