Reasons for decision

The Commissioner of Crown Lands has determined that the proposed activity is one which comes within the provisions of section 66A of the Land Act 1948 and that the terms and conditions specified in the attached permit will minimise any potential adverse effects of the proposed activities.

Conditions of decision

Consent is granted for the recreation permit, subject to the following conditions.

The Grantee shall:

  1. Not remove any vegetation, disturb any soil (and in particular, shall not form any new tracks or trails) or light any fire on the Operational Area.

  2. Not at any time cause any new building, erection, structure of any form (including any fence) or alteration or addition thereto to be placed or carried out upon the Operational Area other than those authorised by the Grantor as set out in the First Schedule of this Permit.

  3. Operate the Activities permitted by this Permit within the Operational Area in a professional, safe and reputable manner in accordance with industry standards and codes of practices, if any.

  4. Comply at all times with all laws including but not limited to all statutes and regulations and obtain all approvals, consents, licences and authorisations by all relevant parties as are necessary for the Grantee to conduct the Activities permitted by this Permit including compliance with all local authority bylaws, rules, regulations and requisition and with the provisions of the Resource Management Act 1991 or the Natural and Built Environment Act 2023 (as the case may be) and any Act in substitution thereof.

  5. In particular, but without limitation, ensure that at all times during the conduct of the Activities the use and possession of any firearms (whether by the Grantee or otherwise) complies in all respects with the provisions of the Arms Act 1983 and Arms Act Legislation Act 2020 legislation as it relates to Shooting Range Management and the requirement for inspection and certification, and any Act in substitution thereof and any regulations thereunder, and the provisions of the Arms Code.

  6. Remove and take away or cause to be removed and taken away all materials, contaminants, refuse, vehicles, and equipment placed on the Operational Area for the purposes of or resulting from the Activities set out in the First Schedule of this Permit. 

  7. Ensure that paintball materials and clay targets are biodegradable and nontoxic and all dispelled clay targets, unbroken clays and visible fragments, arrows and other associated materials are picked up and removed after each event.

  8. Ensure that all clients, guides and other invitees of the Grantee are advised to use the toilet facilities provided in the Operational Area which are to be to be monitored by the Grantee to ensure they provide sufficient capacity. If additional toilet facilities are required, they are to be portable and located where there is no risk of human waste entering a waterway. Where no toilet facilities are available all human waste shall be carried out, in appropriate receptacles, and safety deposited of at an appropriate facility.

  9. Ensure that any damage or disturbance to the surface of the land as a result of the Activities authorised by this Permit is restored to its former condition to the reasonable satisfaction of the Grantor and the Lessee.

  10. Ensure that any vehicles used for the Activities are four-wheel drive and all vehicle use whether motorised or non-motorised (including e-bikes) and horses is kept to formed tracks and participants in the activities follow these formed tracks or well used routes designed to protect the natural features of the land. No formation of tracks where they do not already exist is permitted. The Grantee must further ensure that vehicles are only parked on existing formed roads and firm ground. 

  11. Ensure no horses are permitted in the wetland areas and, where possible all other activities also avoid these wetland areas.

  12. Comply with the provisions of the Health and Safety at Work Act 2015 (and, if applicable, the Health and Safety at Work (Adventure Activities) Regulations 2016) and any Act in substitution thereof and any regulations thereunder.

  13. Ensure that the Activities authorised by this Permit will be confined exclusively to the Operational Area (as defined on the plans attached as the Third Schedule) and use the Operational Area solely for the Activities authorised by this Permit. 

  14. Take all reasonable precautions to guard against danger on the Operational Area of the Grantor’s land.

  15. Not to interfere with or obstruct the Grantor or his/her agent’s employees, contractors or authorised invitees or hinder or interfere with the Lessee’s farming operations or any other recreational permit activities on Little Valley pastoral lease, including the Operational Area.

  16. Ensure that all clients, guides and invitees take all precautions necessary to ensure that weeds are not introduced to the Operational Area, this shall include but not be limited to, ensuring that all tyres, footwear, gaiters, packs and any other equipment used are clean prior to entering the Operational Area.

  17. Ensure the "Leave No Trace" principles of Leave No Trace New Zealand and the New Zealand Environmental Care Code are adhered to at all times however for the avoidance of doubt, if any inconsistencies exist between these principles and the Grantee’s obligations contained in this Permit, these Grantee’s obligations shall prevail at all times.

  18. Comply, and ensure all clients, guides and other invitees of the Grantee comply, at all times with the provisions of the Biosecurity Act 1993 and any amendments or substitutions thereof, and the Ministry for Primary Industry (MPI) Biosecurity New Zealand guidelines, Check, Clean, Dry, cleaning methods as published by MPI to limit the spread of Didymo (Didymosphenia geminate) and other freshwater pests. These cleaning methods The Grantee must regularly check this website (or any replacement website) and update their precautions accordingly. All vehicles, bikes, equipment, clothing, gaiters, or footwear that may come in contact with waterways must be cleaned before and after visiting the Operational Area to these standards to avoid cross contamination of waterways.

  19. Take all reasonable precautions, in relation to any motor vehicle to prevent the accidental starting of any fire, particularly at times of high fire risk. The Grantee must prepare a fire action plan and ensure that the appropriate fire extinguishers, shovels, and/or knapsack sprayers are immediately accessible for use in the event of fire. Furthermore, ensure that all vehicles are adequately equipped to minimise the risk of accidental fire and at least one vehicle in each party is fitted with an operative fire extinguisher, shovel and hand fire beaters. In the event that NIWA and Fire and Emergency New Zealand’s Fire Danger Rating System shows fire danger to be rated as high or extreme, vehicle tours should not take place. 

  20. Not release any game animals or any pest species on the Operational Area to facilitate the hunting activity. Furthermore, no processing of any animals hunted as part of the Activities shall occur within 50 metres of any water body, water source or public road or track and no carcasses, offal or rubbish from the said processing is to be left in streambeds or within 50 metres of any water body, water source, public road or track.

  21. Ensure that neither historical artifacts, sites or resources, if present on or adjoining the Operational Area, are disturbed nor relics removed by the Grantee or any clients, guides, or invitees in the Activities under this Permit. If any unidentified archaeological site is discovered the Heritage New Zealand Pouhere Taonga Archaeological Discovery Protocol must be followed, and the Department of Conservation – Central Otago District Office must be notified at wanakacv@doc.co.nz

  22. Be aware that the Operational Area could be subject to Part IVA Conservation Act 1987. Therefore, marginal strips may be present within the Operational Area, these are administered by the Department of Conservation and are excluded from this Permit.
