Reasons for decision
The Commissioner of Crown Lands has determined that the proposed activity is one which comes within the provisions of section 66A Land Act 1948, and that provided the terms and conditions specified in the attached permit are adhered to, these will minimise any potential adverse effects of the proposed activities on inherent values that it is considered desirable to protect. The proposed fee is intended to be a fair fee and in accordance with the obligations of the Crown Pastoral Land Act. A small number of amendments have also been made to the permit document to align conditions with the DGC advice received.
Conditions of decision
Consent is granted to run an adventure race, subject to the following conditions:
- Not remove any vegetation, disturb any soil or light any fire on the Operational Area.
- Not at any time cause any building, erection, structure or fence or alteration or addition thereto to be placed or carried out upon the Operational Area.
- Comply at all times with all statutes and regulations and obtain all approvals, consents and authorisations as are necessary for the Grantee to conduct the activities permitted by this permit.
- Remove and take away or cause to be removed and taken away all materials, structures, contaminants, human waste, refuse, vehicles, equipment and vegetation placed on the site for the purposes and activities set out in the First Schedule.
- Ensure that any damage or disturbance to the surface of the land as a result of the activities allowed by the Permit is restored to its former condition to the reasonable satisfaction of the Grantor and Lessee.
- Ensure that all vehicle use is kept to formed tracks.
- Comply with the provisions of the Health and Safety at Work Act 2015.
- Ensure that the activities authorised by this Permit will be confined exclusively to the Operational Area and use the Operational Area solely for the activities authorised by this permit.
- Take all reasonable precautions to guard against danger on the Grantor’s land.
- Not to interfere or obstruct the Grantor or his/her agent’s employees or contractors or authorised invitees.
- Comply at all times with the provisions of the Biosecurity Act 1993 and the Biosecurity New Zealand guidelines, including compliance with guidelines for limiting the spread of Didymo as published by Biosecurity New Zealand.
- Take all reasonable precautions, in relation to any motor vehicle to prevent the accidental starting of any fire, particularly at times of high fire risk.
- The “leave no trace” principles of Leave no Trace New Zealand and the New Zealand Environmental Care Code must be adhered to at all times. Leave No Trace New Zealand
- All necessary precautions must be taken to ensure that no weeds are introduced onto the Land. This includes ensuring that all equipment used by lessees, staff, and clients is thoroughly cleaned.
- Pre-race information/briefings are to feature discussion of conservation values, and how to mitigate impacts on the land and other visitors to the area.
- All signage, route and track marking must be temporary, if fixed to trees it should be tied not nailed or stapled.
- Toileting facilities for all officials and participants must be provided. Any toilet facilities provided should be completely self-contained, and all waste removed from site.
- Mountain biking should be restricted to established tracks whenever possible and avoid all wetlands including ephemeral.
Recreation permits granted by the Commissioner of Crown Lands also incorporate (with minor variations) the terms set out in Appendix H of the Standard for purchase, alienation, and administration of Crown land - LINZS45002.
