Reasons for decision

The Commissioner of Crown Lands has determined that granting consent to burn piles of cleared scrub and tree waste will make it easier to use the land for farming purposes. Any adverse effects on inherent values can be minimised through compliance with the conditions specified above; once land is cleared it is considered appropriate to allow the cleared areas to be maintained.

Conditions of decision

Consent is granted for burning, subject to the following conditions:

  1. Burning is to be restricted to those areas identified as being approved on the attached map.
  2. Burning is restricted to piles of vegetation arising from scrub clearance only.
  3. Burn locations must be positioned to avoid risk to indigenous vegetation and any threat to adjacent areas.
  4. A burn management plan is prepared to ensure best practice methods are applied, the risk of escaped fire is minimised, adequate and experienced personnel are on site for the duration of the burn, contacts are prepared for fire suppression if this becomes necessary, and the burnt area is inspected thoroughly following the completion of the burn, to ensure the fire is completely extinguished before leaving the area.
  5. No burning shall occur within at least 10 metres either side of any wetland or permanent waterway.
  6. Any other necessary burning permits or consents are to be held and conditions met as imposed by Fire and Emergency New Zealand (FENZ), local Rural Fire Authority and/or those required under other enactments.
  7. FENZ should be consulted as necessary about the burn, for advice and guidance on management within the designated area(s) and maintaining setbacks.
  8. Toitū Te Whenua LINZ and any landowner within 1km of an area which is planned to be burned shall be informed at least 48 hours prior to the burn taking place.
  9. LINZ shall be notified within 24 hours of completion of the burn. This notification should confirm that all conditions have been complied with, and/or advise of any incidents or issues that may have occurred during the work. Any fire that burns outside the area for which consent has been granted, for whatever reason, is to be reported to the Commissioner of Crown Lands supplying full details of the circumstances.
  10. Oversowing and top-dressing of areas where the burning occurred within 12 months of the burn to reduce invasion by pest plants and reduce erosion risk.
  11. That any staff member or contractor undertaking the scrub clearance is provided with a copy of the consent.

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
