Reasons for decision

The Commissioner of Crown Lands has determined that granting consent to maintain tracks will make it easier to use the land for farming purposes, and that any adverse effects on inherent values can be minimised through compliance with the conditions specified above

Conditions of decision

Consent is granted to maintain tracks, subject to the following conditions:

  1. Maintenance is to follow the existing alignment of the tracks.
  2. Maintenance limited to provide a safe operating surface that does not exceed 3 metres in width and minimising cuts and side-spill.
  3. Indigenous shrubland >1.5m high and ‘At Risk’ plant species (e.g. Olearia lineata, Olearia odorata, Carmichaelia petriei and Carmichaelia compacta) are to be avoided.
  4. That soil disturbance associated with the construction of tracking is kept to the minimum required to meet the objectives.
  5. NZAA recorded archaeological sites are not to be disturbed.
  6. In the event of an accidental discovery of any archaeological sites, work will stop, and the lessee shall advise Heritage New Zealand of the discovery.
  7. Disturbed areas are to be oversowing and topdressed within 12 months of disturbance to reduce erosion risk and landscape effects.
  8. Maintenance is to be undertaken in accordance with best practice.
  9. Be aware that marginal strip & legal road may be present and these are administered by other agencies; therefore those lands are excluded from this Notice of Decision.
  10. Any contractor machinery and vehicles are to be cleaned of soil and plants prior to entry to the lease to minimise the possibility of weed infestation. Any fuel and oil storage facilities are to be sited to eliminate the possibility of a leak or spill into any waterways.
  11. That all contractors and employees working on Gorge Creek Station under this consent notice are informed of the conditions prior to the works commencing 

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
