Instruments must include the information required under the Land Transfer Act 2017 (LTA) and Land Transfer Regulations 2018 (LTR), or other relevant statutes.
An instrument specified in Schedule 2 of the LTR that is lodged for registration or noting must contain:
- the core information specified in regulation 5(2) of the LTR, and
- the additional information and accompanying documents (if any), specified in Schedule 2.
The required information should generally be contained in the body of the instrument itself. Instruments may also incorporate standard provisions by reference to a memorandum registered under s209 of the Land Transfer Act 2017, where it is practical to do so.
The forms approved by the Registrar-General of Land set out how the required information may be presented when preparing instruments for registration.
