Revocation of a permit – s39 Crown Minerals Act 1991

When a permit is revoked a copy of the notice served on the permit holder under s39(3) or (3A) of the Act must be lodged with LINZ under s39(8)(a) of the Act.  This applies to permits,  other than permits in respect of petroleum, granted before 21 August 2003. 

To lodge a notice of this type, use the instrument code: RMIP – Revocation of Mining Permit under Crown Minerals Act 1991. 

This is an image-only instrument signed by the Minister of the Crown. 

On receipt of the notice, LINZ will record the revocation on the relevant record of title.

Surrender of a permit – s40 Crown Minerals Act 1991

When a permit is surrendered the surrender of the permit, whether in whole or in part, must be lodged with LINZ under s40(9)(a) of the Act. This applies to permits, other than permits in respect of petroleum, granted before 21 August 2003.

If a permit is surrendered in part only, the surrender must be accompanied by a plan that clearly shows which part of the permit is being surrendered. 

To lodge a surrender of the permit, use the instrument code: SMIP – Surrender Mining Permit under Crown Minerals Act 1991. 

To lodge a partial surrender of the permit, use the instrument code: PMIP – Partial Surrender Mining Permit. 

These are image-only instruments signed by the permit holder.

On receipt of the surrender instrument, LINZ will record the surrender on the relevant record of title.

Notice of access rights on land titles – s83(1) Crown Minerals Act 1991

On entering into an access arrangement under s83(1) of the Act, the permit holder or applicant for a permit must lodge with LINZ a notice of the particulars of the arrangement with a copy of the arrangement attached. 

To lodge a notice of this type, use the instrument code: N83 – Notice of access rights under Crown Minerals Act 1991. 

This is an image-only instrument signed by the permit holder or applicant for a permit.

On receipt of the notice, LINZ will record the notice on the relevant record of title.

Notice the access rights have expired – s83(4) Crown Minerals Act 1991

On the expiry of an access arrangement, the permit holder or applicant for a permit must lodge with LINZ a notice that the access arrangement has expired. 

To lodge a notice of this type, use the instrument code: E83 – Expiry of Access Rights.

On receipt of the notice, LINZ will record the expiry on the relevant record of title.

Notation of mineral ownership – s86 Crown Minerals Act 1991

A person may apply to have entered on any fee simple title the ownership of all or any minerals in the land.

To lodge an application, use the instrument code: A86 – Application for ownership of Minerals under Crown Minerals Act 1991. 

This instrument can only be lodged by manual dealing.

On receipt of an application, LINZ will record the ownership on the relevant record of title.

Notification of expiry of a permit – s88(1) Crown Minerals Act 1991

A permit holder must notify LINZ when a permit expires in accordance with s88(1) of the Act.  This applies to permits, other than a permit in respect of petroleum, granted before 21 August 2003.

To lodge a notice of this type, use the instrument code: EMIP – Expiry of Permit.

On receipt of the notice, LINZ will record the notice/expiry on the relevant record of title.
