The Land Transfer Act 2017 provides a process for anyone who is concerned that information on the register will disclose their whereabouts and prejudice their safety to apply to have that information withheld from the register so that it is not publically available.

This standard sets timeframes for decisions on section 42 applications to the Registrar to withhold information on the register for a person’s safety. These timeframes include circumstances where an application contains insufficient information or where further information from an applicant is requested. The standard is made under section 236 of the Land Transfer Act 2017.

Note that there is a comparable process to withhold information where applicants have a protection order (section 109 of the Domestic Violence Act 1995).
