Before you create a new dealing

What you need to know before creating a dealing in Landonline.

Another user has the dealing open

If a user closes their browser window without existing a dealing correctly the dealing will automatically lock. If left inactive for more than 20 minutes the dealing will automatically unlock.

Otherwise you can ask the user to unlock.

Decide which party will create the dealing

Before you start decide which party will create the dealing. For example, for a sale and purchase this will usually be the primary contact acting for the transferee.

When creating a dealing Landonline allocates a dealing number which is used to identify the dealing throughout the conveyancing process.

The order in which instruments display on the Instrument & Roles page determines the order in which they are registered.

You are responsible for ensuring correct details are included in a dealing. If any information is not correct the risk and responsibility lies with you to correct it.

Memorials flagged as stops

Memorials flagged as stops by LINZ also prevent you automatically registering a dealing unless a certification can be given for the stop instrument, such as a caveat.

Where a certification cannot be given for a stop instrument, information supporting registration may need to be added to the instrument.

Text added or images attached will cause the instrument to step down to Lodge.

Registered owners and multiple estates

Registered owner details are populated for titles with multiple estates in different ways.

Below describes the differences depending on the mode used.

Names and shares are the same for each estate

Title mode: Names display once.

Complex mode: Names and shares display only once, they will not display for each estate.

Example

A and B as to 1/2 a share and A and C as to 1/2 a share for 2 estates will show as:

A and B as to 1/2 a share and A and C as to 1/2 a share.

Instrument: Not affected by multiple estates on the title.

Names are the same for each estate, shares are different

Simple for a Transfer or Mortgage and Share/Interest for a Partial Discharge: Names display once.

Complex, for a Transfer and Title, for a Transmission: Names and shares for each estate display grouped together in their estates. A message displays asking you to define the registered owner details using the Add Text button.

Instrument: Not affected by multiple estates on the title.

Names are different for different estates

Simple or Share/Interest: This mode is not available and will be greyed out. For a Partial Discharge of Mortgage Share/Interest mode lists each name separately.

Complex for a Mortgage or Transfer and Title for a Transmission: Automatically defaults to this mode. Names and shares for each estate display grouped together in their estates. A message displays asking you to define the proprietor details using the Add Text button.

Instrument: Not affected by multiple estates on the title.

Setting up a dealing instrument with multiple parties

You need to make sure the dealing is set up correctly on the Instrument & Roles page, particularly for instruments that have:

  • multiple titles
  • different ownership
  • different solicitors acting for the different parties.

Example: Easement instrument

An example is where there are 2 titles in an easement instrument and the owners of those titles are granting reciprocal easements. The owners will be both grantor and grantee.

Presuming the owners have different representation, when setting up the dealing you need to create 2 roles for both the grantor and grantee roles.

Conveyancing professionals (CPs) completing certifications will need to:

  • select their client's names
  • complete the certifications as both grantor and grantee
  • make sure an A&I is completed by the clients that authorise the CP to act as both grantor and grantee.

Title restrictions

Gazette Notices and Life Estate titles are restricted by us based on regulatory requirements. Restrictions are based on the title type and estate type of the title.

If you try to register against a restricted title your dealing will step down to Lodge to be checked by our staff.

If you create a dealing against a restricted title the affected instrument will step down to Lodge when you enter the title against an instrument in the Instrument & Roles page.

If you pre-validate your dealing early you'll be alerted to any restrictions against titles.

When owners details don't display

The details for the registered owner will not display for affected titles subject to a withholding direction (hidden title).

To add names, toggle on Change due to pending dealing. Then enter details in the name fields
