Reasons for decision

The Commissioner of Crown Lands that the benefits to farming from maintaining the existing tracks on the lease are considerable and will make the land easier to farm.  The conditions will help reduce, remedy, avoid or mitigate any effects on the inherent values and landscape.

Conditions of decision

Consent is granted for track maintenance, subject to the following conditions:

  1. That track maintenance is limited to the areas as indicated on the map attached to the Notice of Decision.
  2. For the avoidance of doubt, this consent replaces all other consents granted for the construction of tracks for the tracks depicted in blue.
  3. Maintenance of existing tracks is confined to the existing footprint of the tracks. The track maintenance shall not result in the track being widened any further.
  4. That soil disturbance is kept to the minimum necessary for the maintenance and that appropriate machinery is employed on the task to achieve this.
  5. The tracks may be maintained to a level suitable for four-wheel drive vehicles.
  6. That all machinery intended to be used for maintaining the track is cleaned of plant material and soil prior to entering Glen Lyon Station to avoid weed contamination.
  7. Damage to archaeological sites should be avoided, or an Archaeological Authority from Heritage New Zealand Pouhere Taonga will be required.
  8. In the event of any accidental discovery of any archaeological sites, work must stop, and the accidental discovery protocol should be followed (a copy of this is appended). The Lessee should then advise Heritage New Zealand Pouhere Taonga of the discovery.
  9. That all contractors and employees of Glen Lyon Limited engaged in the track maintenance are informed of the conditions of this consent prior to works starting

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
