Reasons for decision
The Commissioner has determined that the proposed cultivation has positive farming benefits, and the conditions will enable any adverse effects on inherent values to be avoided, remedied or mitigated. Benefits include increasing the quality and quantity of grazing available to stock, which should have flow on benefits in terms of better animal health and performance.
Conditions of decision
Consent is granted for cultivation, subject to the following conditions:
- Cultivation will only occur within the areas indicated as being approved as shown on the map attached to this Notice of Decision.
- Cultivation methods may include discing, rolling and direct drilling. Preference shall be given to minimum tillage techniques where possible.
- No cultivation shall occur within 3m of any water race or within 3m of any ephemeral or permanent waterway.
- No cultivation shall occur within 5m of the small patch of Olearia lineata as identified on the map attached to the Notice of Decision.
- The return cultivation cycle is restricted to not more than once in every 6 years. Continued inputs of maintenance fertiliser are applied to extend the effective life of the crop/pasture to reduce the need and frequency for renewal of cultivation.
- In the event of any accidental discovery of any archaeological sites, work must stop, and the accidental discovery protocol should be followed.
- Damage to archaeological sites, including the water races, should be avoided. If damage is possible, an Archaeological Authority from Heritage New Zealand Pouhere Taonga will be required.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
