What the decision relates to

Carrying sheep and cattle

Duration of consent

Personal to holder

Reasons for decision

The Commissioner of Crown Lands grants consent to an exemption to the stock limitation in the lease to allow the leaseholder to carry the following stock:

  • A total of 4230 sheep (including not more than 2710 breeding ewes) and not more than 40 cattle (excluding breeding cows).

The Commissioner of Crown Lands has determined that on balance the benefits of granting consent to the stock exemption, in reference to the granting to subdivide the Rostriever pastoral lease, fulfils Notice of Decision A4226421 condition 1.v “Obtaining and complying with Commissioner of Crown Lands consent for stock exemptions on Rostriever and Mt Thomas leases”.

The stock exemption is an apportionment of the previous holder’s exemption, is equal to or less than the exemption granted, and the Commissioner is satisfied that the provisions of s 15(4) Crown Pastoral Land Act 1998 have been met.

Conditions of decision

Consent is granted for a stock limitation exemption, subject to the following conditions:

  1. That the exemption to the stock limitation is on condition that the lease is run in conjunction with the 40 hectares of freehold land and 88 hectares of leasehold land (Waitaki District Council).
  2. That should the availability of the 40ha of freehold land and/or 88ha of leasehold Waitaki District Council land change, a new application for a stock exemption is to be made to the Commissioner of Crown Lands.
  3. The Rostriever Block stock exemption is to take effect on the date of registration of a new Record of Title for Rostriever block pastoral lease.

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
