What the decision relates to

Cultivation

Duration of consent

10 years with maintenance rights

Reasons for decision

The Commissioner of Crown Lands has determined that the area applied for has previously been substantially modified. There will be no adverse effects on inherent values and the benefit to farming is through the strategic location of the area to be cultivated, being close to the shearing shed and associated yards. The conditions ensure that the soil resource is maintained and weeds are not introduced.

Conditions of decision

Consent is granted for cultivation, subject to the following conditions:

  1. Cultivation is limited to the approved area as indicated on the map attached to the Notice of Decision.
  2. Initial cultivation can include the removal of rocks within the area to allow for easier discing/direct drilling.
  3. Spraying of existing vegetation can be undertaken as part of the initial step towards cultivation, and at the beginning of each cultivation cycle.
  4. Each cultivation cycle is restricted to not more than two feed crops before sowing down in permanent pasture.
  5. Acceptable pasture species are clovers, cocksfoot, ryegrass and fescue grass.
  6. The return cultivation cycle is restricted to not more than once in every 7 years.
  7. Minimum cultivation/direct drilling/cover crops and rough seed bed techniques are to be adopted to ensure soils are not over worked and exposed to wind erosion.
  8. Continued inputs of maintenance fertiliser are to be applied to extend the effective life of permanent pasture stands which will reduce the need for renewal cultivation.
  9. Cultivation will only occur when soil conditions are moist and there is little to no wind.
  10. All machinery brought to the site to carry out any cultivation work should be cleaned of any earth and plant material prior to access to reduce the potential for the spread of weeds.
  11. That all contractors and employees of KMAH Limited Partnership, or its successors, are informed of the conditions of this consent prior to cultivation commencing.

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
