Kia ora koutou, and welcome to our first overseas investment Pānui for 2025! I hope you’ve had a restful break and managed to find some sunshine over the holidays.  

The overseas investment team is right back into it, and we’re looking forward to continuing the great progress made in 2024 on improving application timeframes and processes.  

This week we’ve released new guidance on investments in solar and wind farms, which provides important information about how such developments are treated under the Overseas Investment Act, and what to be aware of when making an application.

New and updated guidance  

New factsheet - Investing in solar and wind farms  

We have produced new guidance about investing in solar and wind farms under the Overseas Investment Act 2005.

Solar farms in particular are becoming more common in New Zealand, with several land acquisitions for solar purposes consented under the Act since 2022. To date, all solar farm related applications have received overseas investment consent.  

This new guidance outlines the criteria for consent for solar and wind farms, and helps investors and their legal advisors understand the differences in how solar and wind farms are treated under the Overseas Investment Act.  

It also highlights aspects of solar farm developments that are different to wind farms, including land tenure arrangements and complementary land use.

Discretionary exemptions

We have also updated our online guidance on discretionary exemption applications.  

This guidance highlights the factors we may take into account when assessing exemption applications, and includes an example of an exemption scenario. 

Discretionary exemptions are available in limited circumstances, and in many instances an application for consent is more appropriate. If you are considering applying for a discretionary exemption, we recommend you contact us early to arrange a pre-application meeting.

Our next Ngā Hui Whakamārama session will be held at 10:30am on Tuesday 18 February, and invites will be sent out soon.
