If your neighbour has land that is limited as to parcels and they re-survey it to remove the limitation and obtain a guaranteed record of title, the Registrar-General of Land (the Registrar) will notify you in accordance with section 202(1)(b) of the Land Transfer Act 2017.
The notice
A notice to an adjoining owner or occupier will read:
Section 202(1)(b): Notice to Adjoining Owner or Occupier
This notice is to advise you that land adjoining your property is being re-surveyed and to give you the opportunity to confirm that there is no encroachment on your land. You may do so by inspecting either the Cadastral Survey Dataset or the boundary marks on the land. A copy of the Cadastral Survey Dataset is attached for your information.
How to stop the removal of limitation
If you disagree with the new survey, you may lodge a caveat against the limited record of title that is limited as to parcels under section 207 of the Land Transfer Act 2017.
