Applicant: Batch Film Limited

The proposed activity falls within the provisions of Section 66A of the Land Act 1948 and the terms and conditions below will minimise any potential adverse effects of the proposed activity. As a result, the adverse effects on the inherent values will be no more than minor. 

Conditions of decision

Consent is granted for filming on the area identified in the attached plan as the ‘Operational Area’, subject to the following conditions:

  1. Not remove any vegetation, disturb any soil or light any fire on the Operational Area to improve shots, camera angles or facilitate access to the sites.
  2. Not at any time cause any building, erection, structure or fence or alteration or addition thereto to be placed or carried out upon the Operational Area.
  3. Comply at all times with all statutes and regulations and obtain all approvals, consents and authorisations as are necessary for the Grantee to conduct the activities permitted by this Permit.
  4. Remove and take away or cause to be removed and taken away all materials, structures, contaminants, human waste, refuse, vehicles, equipment and vegetation placed on the site for the purposes and activities set out in the First Schedule.
  5. Ensure that any damage or disturbance to the surface of the land as a result of the activities allowed by the Permit is restored to its former condition to the reasonable satisfaction of the Grantor and Lessee.
  6. Ensure that all vehicle use is kept to formed tracks. Vehicles must be parked, and helicopters must land on firm ground.
  7. Comply with the provisions of the Health and Safety at Work Act 2015.
  8. Ensure that the activities authorised by this permit will be confined exclusively to the Operational Area and use the Operational Area solely for the activities authorised by this permit.
  9. Take all reasonable precautions to guard against danger on the Grantor’s land.
  10. Not to interfere or obstruct the Grantor or his/her agent’s employees or contractors or authorised invitees.
  11. Comply at all times with the provisions of the Biosecurity Act 1993 and the Biosecurity New Zealand guidelines, including compliance with guidelines for limiting the spread of Didymo as published by Biosecurity New Zealand.
  12. Take all reasonable precautions, in relation to any motor vehicle to prevent the accidental starting of any fire, particularly at times of high fire risk.
  13. Prepare a fire action plan and keep on-site appropriate fire extinguishers, shovels, and/or knapsack sprayers for use in the event of fire.
  14. Be aware that the Operational Area could be subject to Part IVA Conservation Act 1987. Therefore, marginal strips may be present within the Operation Area, these are administered by the Department of Conservation and are excluded from this permit.
  15. The Turret Head location is very close to the Pikirakatahi Topuni boundary, and any filming or photographs are to be directed away from this area, in the opposite direction so as not to feature the Topuni location.
  16. Drone use – The grantee must not; 
    • Fly closer than 50m in any direction to protected wildlife on the land; 
    • Fly more than three drones within 300m of any wildlife; 
    • To mitigate impacts of filming on kea, drones must not be active if kea are visible from the filming site.
  17. No wildlife is to be enticed with food or harassed in any way.
  18. All Queenstown Mountain Bike Club Tracks – the grantee must obtain permission from the Queenstown Mountain Bike Club before filming on tracks.
    Recreation permits granted by the Commissioner of Crown Lands also incorporate (with minor variations) the terms set out in Appendix H of the Standard for purchase, alienation, and administration of Crown land - LINZS45002.
