Reasons for decision

Maintaining this track will provide a significant benefit to the farming operation and improve health and safety. It is considered that the adverse effects on inherent values can be avoided, remedied or mitigated by the conditions placed on the Commissioner of Crown Lands approval.

Conditions of decision

Consent is granted for maintaining tracks on the applicable map, subject to the following conditions:

  1. That track maintenance is limited to the area as indicated on the applicable map.
  2. That those areas of the track, as indicated in pink on the applicable map, are likely to be located outside of The Beeches II legal boundary, and that permission to maintain these areas should be sought from the Department of Conservation.
  3. The track maintenance shall not result in the track being widened any further.
  4. That soil disturbance is kept to the minimum necessary for the maintenance and that appropriate machinery is employed on the task to achieve this.
  5. The track may be maintained to a level suitable for four wheel drive vehicles.
  6. That all machinery intended to be used for maintaining the track is cleaned of plant material and soil prior to entering Beeches II Station to avoid weed contamination.
  7. That the Accidental Discovery Protocol is followed during track maintenance. (The Accidental Discovery Protocol requires that in the event of an 'accidental discovery' of an archaeological site or material all activity in the area must cease and LINZ, DOC and the Dunedin archaeologist of Heritage New Zealand must be advised. Works will not recommence until an archaeological assessment has been undertaken and reviewed).
  8. That all contractors and employees of Beeches II Station engaged in the track maintenance are informed of the conditions of this consent prior to works starting.

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
