Reasons for decision
The Commissioner of Crown Lands has determined that the proposed activity is one which comes within the provisions of section 66A Land Act 1948, and that provided the terms and conditions specified in the attached permit are adhered to, these will minimise any potential adverse effects of the proposed activities on inherent values that it is considered desirable to protect. The additional clauses are to mitigate possible adverse effects through loss of indigenous vegetation or soil erosion.
Conditions of decision
Consent is granted, subject to the following conditions:
- Not remove any vegetation, disturb any soil or light any fire on the Operational Area
- Not at any time cause any building, erection, structure or fence or alteration thereto to be placed or carried out upon the Operational Area
- Comply at all times with all statutes and regulations and obtain all approvals, consents and authorisations as are necessary for the Grantee to conduct the activities permitted by this permit.
- Remove and takeaway or cause to be removed and taken away all refuse.
- Comply with the provisions of the Health and Safety at Work Act 2015.
- Ensure that all activities authorised by this permit will be confined exclusively to the Operational Area and use the Operational Area solely for the activities authorised by this permit.
- Take all reasonable precautions to guard against danger on the Grantors land.
- Not interfere or obstruct the Grantor or his/her agent’s employees or contractors or authorised invitees.
- Only use the formed tracks on the land.
- Not use vehicles prohibited by the Grantor.
- Maintain and repair tracks, fences, gates buildings and other structures.
- If camping outdoors, ensure all cooking and heating requirements are to be gas only.
- Implement a logbook system for all recreational activities described in the First Schedule and include duration of trips, names of clients and times they are due back at the station homestead.
- Restrict all vehicle activity to existing identified tracks and acknowledge that “wander at will” is not permitted.
- Not to entitle, in anyway, to manage Himalayan Thar or Chamois within the Operational Area unless holding an appropriate permit or consent.
- Ensure that all Himalayan tahr numbers are compatible within the Department of Conservation’s Himalayan Tahr Control Plan.
Recreation permits granted by the Commissioner of Crown Lands also incorporate (with minor variations) the terms set out in Appendix H of the Standard for purchase, alienation, and administration of Crown land - LINZS45002.
