Reasons for decision

It is considered that the benefits to farming from maintaining the existing tracks on the lease are considerable and will make the land easier to farm. The conditions will help reduce, remedy, avoid or mitigate any effects on the inherent values and landscape.

Conditions of decision

Consent is granted subject to the following conditions:

  1. Track maintenance is limited to the area as indicated on the map attached to the Notice of Decision.
  2. Please note that any tracks constructed under the Crown Pastoral Land Act 1998 and where the Notice of Decision is still on file, shall remain subject to the conditions of that Notice of Decision, rather than those conditions specified in this Notice of Decision.
  3. Maintenance of existing tracks is confined to the existing footprint of the tracks. The track maintenance shall not result in the track being widened any further.
  4. Soil disturbance is kept to the minimum necessary for the maintenance and that appropriate machinery is employed on the task to achieve this.
  5. Any bare soil surfaces are to be revegetated with the previous cover or re-seeded and top-dressed with a certified permanent pasture mix as soon as possible after completion of the activity.
  6. The tracks may be maintained to a level suitable for four-wheel drive vehicles.
  7. All machinery intended to be used for maintaining the track is cleaned of plant material and soil prior to entering The Dasher Station to avoid weed contamination.
  8. Damage to archaeological sites should be avoided, or an Archaeological Authority from Heritage New Zealand Pouhere Taonga will be required.
  9. Adequate water tables are to be provided with cut-outs and/or culverts where required. The outflow from any cut-out or culvert is to be constructed to minimise erosion risk.
  10. Any culvert constructed in an active stream is to be constructed in a manner to allow fish passage.
  11. In the event of any accidental discovery of any archaeological sites, work must stop, and the accidental discovery protocol should be followed. The Lessee should then advise Heritage New Zealand Pouhere Taonga of the discovery.
  12. All contractors and employees of McNaughton Farms Limited engaged in the track maintenance are informed of the conditions of this consent prior to works starting. 

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
