Reasons for decision
The Commissioner’s delegate has determined that granting consent to disturb soil to construct multiple fences while complying with the above conditions will benefit farming and protect the inherent values identified.
Conditions of decision
Consent is granted for fencing, subject to the following conditions:
- All machinery and materials shall be cleaned of plant matter and soil prior to entering the lease to avoid introduction of pest plants.
- Vegetation clearance and soil disturbance will be confined to the minimum width necessary for the safe construction and maintenance of the fence.
- Avoid fence lines passing through grey scrub of patches more than 10m2.
- Avoid mature scrub, including individuals more than 1.5m in height.
- Archaeological sites must be avoided, or an Archaeological Authority from Heritage New Zealand Pouhere Taonga will be required.
- In the event of an accidental discovery of any archaeological sites, work must stop. The lessee should then advise Heritage New Zealand Pouhere Taonga of the discovery.
- Disturbed soil is to be re-seeded and topdressed with a certified weed and impurities-free permanent pasture mix as soon as possible after completion of the activity. Any bare soil should be sown with seed as soon as practical.
- Soil disturbance of a width no greater than 3m will be carried out using methods that will cause the least soil disturbance including the use of a digger.
- The use of a bulldozer is permitted for the Sawdon Gully fence subject to the following conditions:
- For the Sawdon Gully fence, soil disturbance of up to 4m in width is provided for.
- Cut-outs shall be installed every 30-50m in steeper sections, in order to minimise runoff and scouring; and
- Any uphill batters are to be sloped off or struck back to minimise slumping and allow re-grassing.
- All necessary steps being taken to avoid the risk of fire.
- All contractors and employees of Sawdon Pastoral Lease are informed of the conditions of this consent prior to the soil disturbance works starting.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
