Reasons for decision

The Commissioner of Crown Lands has determined that granting consent to disturb soil to create a flood bank subject to the conditions will benefit the property and also protect the inherent values noted by the Director General of Conservation. 

Conditions of decision

Consent is granted for soil disturbance, subject to the following conditions: 

  1. That all machinery brought on site is properly cleaned to prevent the introduction of foreign weeds to these areas of the property.
  2. No work shall be undertaken during Pomahaka galaxiid spawning season of October – November inclusive.
  3. No disturbance to the wetted bed of the river.
  4. All precautions shall be taken to minimise sediment runoff into waterways.
  5. Only the surface layer of stones may be collected, with no disturbance to the underlying soil.
  6. All overburden shall be removed out of the river fairway for disposal.

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
