Reasons for decision

The Commissioner of Crown Land has determined that granting consent to disturb soil to construct a deer fence and cultivate land in conjunction with the deer trap while complying with the above conditions will benefit farming and protect the inherent values mentioned by the Director General of Conservation. 

Conditions of decision

Consent is granted for cultivation, subject to the following conditions:

New Area

  1. Soil disturbance for fencing is no closer than 10 m from any marginal strip at any point.  
  2. Cultivation is restricted to the flatter ridge area between the Hukarere boundary and top track as shown in the attached plan.  
  3. All machinery and materials shall be cleaned of plants and soil prior to entering the lease to avoid the introduction of pest plants.
  4. Minimum tillage techniques used
  5. Soil disturbance will be done using methods that will cause the least soil disturbance including the use of a digger
  6. All disturbed surfaces are to be over sown with a suitable seed and fertiliser mix to avoid erosion (consents are held for oversowing and topdressing)

Maintenance

  1. Cultivation is limited to the current footprint and does not include any marginal strips (25m on Sandy Creek and 20m on other waterways).
  2. All machinery and materials shall be cleaned of plants and soil prior to entering the lease to avoid the introduction of pest plants.
  3. Minimum tillage techniques are to be adopted and return periods maximised.
  4. Cultivated areas are to be maintained with adequate fertiliser based on soil testing.
  5. Drainage is limited to maintaining existing drains and must not lead to sedimentation of waterways.  Additional field drains may be installed in wet areas that have previously been cultivated.

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
