Reasons for decision
The Commissioner of Crown Lands has determined that granting consent to maintain existing tracks on Cloudy Peaks Pastoral Lease, will be of negligible impact. The conditions are to reduce the risk of new weed infestations and soil erosion.
Conditions of decision
Consent is granted for maintenance of tracking, subject to the following conditions:
- That track maintenance is limited to the area as indicated on the map attached.
- Maintenance of existing tracks is confined to the existing footprint of the tracks. The track maintenance shall not result in the track being widened any further.
- That soil disturbance is kept to the minimum necessary for the maintenance and that appropriate machinery is employed on the task to achieve this.
- Disturbed soil is to be re-seeded with a certified permanent pasture mix as soon as possible after completion of the activity.
- All machinery intended to be used for maintaining the track is cleaned of plant material and soil prior to entering Cloudy Peaks to avoid weed contamination.
- Adequate water tables are to be provided with cut-outs and/or culverts where required. The outflow from any cut-out or culvert is to be constructed to minimise erosion risk
- Uphill batters are to be sloped off or struck back to minimise slumping and allow re-grassing.
- Run-off transfer should be to an area where any sediment can settle or be filtered by vegetation before it reaches a waterway.
- Tracks must be maintained and kept clear of debris that could impede drainage.
- Any fuel and oil storage facilities are to be sited to eliminate the possibility of a leak or spill into any water ways.
- The lessee is responsible for ensuring any contractor operates under the conditions of this consent.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
