Reasons for decision
The Commissioner of Crown Lands considers that the benefits to farming from maintaining the existing tracks on the lease are considerable and will make the land easier to farm. The conditions will help reduce, remedy, avoid or mitigate any effects on the inherent values and landscape.
Conditions of decision
Consent is granted, subject to the following conditions:
- That track maintenance is limited to the area as indicated on the map attached to the Notice of Decision.
- Please note that this Notice of Decision and the conditions attached overrides all other Notices of Decision regarding existing tracks as depicted on the attached map.
- The maintenance of existing tracks is confined to the existing footprint of the tracks. The track maintenance shall not result in the track being widened any further.
- That soil disturbance is kept to the minimum necessary for maintenance and that appropriate machinery is employed to achieve this task.
- The tracks may be maintained to a level suitable for four-wheel drive vehicles.
- That all machinery intended to be used for maintaining the track is cleaned of plant material and soil prior to entering Te Akatarawa Station to avoid weed contamination.
- Be aware that marginal strip & legal road may be present within the attached map. These are administered by other departments and agencies; therefore, those lands are excluded from this Notice of Decision.
- That all contractors and employees engaged in the track maintenance are informed of the conditions of this consent prior to works starting.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
