Reasons for decision

The Commissioner of Crown Lands has determined that granting consent for soil disturbance to maintain and replace fences will make it easier to use the land for farming purposes, and that any adverse effects on inherent values can be minimised through compliance with the conditions specified above once land is cleared it is considered appropriate to allow the cleared areas to be maintained.

Conditions of decision

Consent is granted to disturb soil, subject to the following conditions:

  1. Replacement is to generally follow the existing alignment of the fence lines (where possible).
  2. Disturbance is to be limited to 5m either side of the existing alignment.
  3. Indigenous shrubland >1.5m high and ‘At Risk’ plant species (e.g. Olearia lineata, Olearia odorata, Carmichaelia petriei and Carmichaelia compacta) are to be avoided.
  4. NZAA recorded archaeological sites are not to be disturbed.
  5. In the event of an accidental discovery of any archaeological sites, work will stop, and the lessee shall advise Heritage New Zealand of the discovery.
  6. Disturbed areas are to be oversowing and topdressed within 12 months of disturbance to reduce erosion risk and landscape effects.
  7. Soil disturbance to be kept to the minimum required to safely construct and maintain an effective fences.
  8. Fenceline preparation to be undertaken with a digger/excavator.
  9. All vehicles and equipment should be clean and clear of any weed seeds prior to entering the site.
  10. That all contractors and employees working on Gorge Creek Station under this consent notice are informed of the conditions prior to the works commencing.

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
