Reasons for decision

The Commissioner of Crown Lands has determined that granting consent to construct the two houses will have positive operational benefits to Lowburn Valley and how the lease is farmed. Appropriate conditions can be applied to this activity to avoid, remedy or mitigate the effects of soil disturbance on the land concerned, which is already highly modified. The Commissioner considers that disturbing the soil at the identified two locations to allow the construction of family housing will make it easier to operate the farm, and that any adverse effects on inherent values can be minimised through compliance with the conditions specified above.

Conditions of decision

Consent is granted for two house sites, subject to the following conditions:

  1. Any soil disturbance for the establishment of each site must be kept to a minimum.
  2. No side spill of earthworks from site excavation.
  3. The sites must be established in a way that runoff does not impact waterways.
  4. Exposed soil areas must be revegetated to match immediate surroundings.
  5. At any time during construction, in the event of any ‘accidental discovery’ of suspected archaeological material, including human remains, The Accidental Discovery Protocol must be followed and adhered to.
  6. That any machinery brought in to carry out the soil disturbance and / or construction of the houses shall be cleaned to remove the risk of possible weed contamination prior to carrying out the work.
  7. That all contractors and employees of Lowburn Station Limited are informed of the conditions of this consent prior to any soil disturbance commencing. 

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
