Reasons for decision
The Commissioner of Crown Lands has determined that the construction of a house and ancillary structures will have positive operational benefits in terms of how the lease is farmed. Appropriate conditions can be applied to avoid or mitigate any the effects of soil disturbance on the land concerned. The siting of the structures within an already cultivated paddock will have less than minor effects on the inherent values, provided the conditions are complied with.
Conditions of decision
Consent is granted for disturbing soil for buildings, subject to the following conditions:
- All conditions listed in the application and Mackenzie District Council decision for RM240167 are adhered to.
- No indigenous vegetation is to be cleared or otherwise damaged.
- All necessary precautions must be taken to ensure that no weeds are introduced onto the land. This includes ensuring that all machinery and construction materials used is thoroughly cleaned prior to entry.
- Any soil removed for the construction process is preferably used at the site for levelling.
- Excess soil is not to be disposed of in gullies or waterways.
- The structures should be in colours that are unobtrusive in that environment.
- That soil disturbance is limited to the minimum required to carry out the proposed works.
- Any disturbed ground will be seeded with previous vegetation as soon as practical following the completion of works.
- Any chemical, fuel and oil storage facilities are to be sited to eliminate the possibility of a leak or spill. Any spill or leak is to be reported to the Commissioner immediately.
- That all contractors and employees carrying out this work on Godley Peaks pastoral lease are informed of the conditions of this consent prior to the construction commencing.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
