You will be presented with multiple certification options when lodging an instrument against a record of title that has a mortgage on it.
You should read the options carefully and give the correct certification. Option 3 or 4 will only display depending on the instrument that is lodged.
Mortgage certification options
Option 1
I certify that the Mortgagee under Mortgage 123456.1 has consented to this transaction and I hold that consent.
Select this option if the mortgagee of the affected mortgage has consented to the instrument being lodged.
Note - If none of the other options apply, you will need to obtain the mortgagee’s consent and select this option.
Option 2
Mortgage 123456.1 is being discharged/extinguished in a prior dealing or in the same dealing.
Select this option if the affected mortgage is being discharged or extinguished (by a transfer in exercise of power of sale) in a prior dealing or in the same dealing as the instrument being lodged.
Option 3
Mortgage 123456.1 does not affect the servient tenement; therefore the consent of the Mortgagee is not required.
This option will display in the case of easements, including variations and surrenders. Select this option if you act for the grantor of the servient tenement that is not affected by the mortgage.
Option 4
Mortgage 123456.1 does not apply to the estate or interest affected by this transaction.
Select this option when the mortgage affects an estate or interest other than the one being dealt with in the transaction.
