Types of caveats you can prepare and the modes you can prepare them in Landonline.

Caveats and business rules

Some caveats can auto register if they relate to an Agreement for Sale and Purchase or Agreement to Mortgage. All mandatory information must be provided, including the registered owner's address.

The instrument must pass the relevant business rules. Caveats that fail the business rules, or ones that include further information in the interest claimed field, or on any other basis will step down to Lodge.

A dealing will also fail a business rule when submitted if a caveat or other instrument that prevents registration is registered against a title after an auto-registered dealing has already been signed.

To avoid rejection, resign the instrument using the appropriate certification once you've taken remedial action.

Types of caveats

Types of caveats you can prepare are:

  • Against dealings with land under s138 Land Transfer Act 2017. This is a standard caveat.
  • Forbidding issue of title removing limitation under s207(1) Land Transfer Act 2017.

Caveat modes

You can prepare caveats in the following modes in Landonline:

  • Simple mode
  • Complex mode
  • Instrument mode.

You can only prepare a caveat forbidding issue of title removing limitation under s207(1) Land Transfer Act 2017 in Complex mode.

The details for the registered owner will not display for affected titles subject to a withholding direction (hidden title).

Registrar's caveats

Caveats can be lodged by the Registrar General of Land (RGL). When lodged these caveats can cause auto-registered dealings to step down to Lodge if they contain:  

  • instruments for which caveat certifications would normally be made. For example, transfer or mortgage. You cannot make a certification for an RGL caveat, and information supporting registration may need to be added to the instrument
  • a Withdrawal or Partial Withdrawal of an RGL caveat
  • PDFs or text added to the caveat.

All other types of discharge, including withdrawals of non RGL caveats, will not be prevented from automatically registering by the RGL caveat.
