You may be presented with multiple certifications when lodging an instrument against a record of title that has a caveat or notice of claim on it.
You should read the options carefully and give the correct certification.
Certification options
Option 1
I certify that the caveator under Caveat Number 123456.7 has consented to this transaction which is subject to the Caveat, and I hold that consent.
Select this option if the caveator (or claimant) of the affected caveat (or notice of claim) has consented to the instrument being lodged.
Note - If none of the other options apply, you will need to obtain the caveator’s (or claimant’s) consent and select this certification.
Option 2
Caveat Number 123456.7 is being withdrawn or removed or an application to lapse will be made, in a prior dealing or in the same dealing.
Select this option if the affected caveat (or notice of claim) is being withdrawn or removed or an application to lapse the caveat (or notice of claim) has been lodged, in a prior dealing or in the same dealing as the instrument being lodged.
Option 3
Caveat Number 123456.7 does not apply to the estate or interest affected by this transaction.
Select this option if the affected caveat (or notice of claim) does not apply to the estate or interest affected by the instrument being lodged. For example, the caveat is against the leasehold estate and the instrument being lodged affects the fee simple estate.
Note - If this option applies, the dealing will step down to Lodge.
Option 4
Caveat Number 123456.7 is limited in its effect and does not forbid the registration of this transaction.
Select this option if the affected caveat (or notice of claim) has an exception clause that allows the instrument being lodged to be registered.
Note - If this option applies, the dealing will step down to Lodge.
Option 5
Caveat Number 123456.7 will lapse as a result of registration of this transaction pursuant to section 141(2) of the Land Transfer Act 2017.
Select this option if the instrument being lodged is a transfer in exercise of power of sale (TPS), and as a result the affected caveat (or notice of claim) will lapse.
