Transfer of a share in Māori freehold land

Information about how to prepare a transfer of a person’s share in Māori land.

Owners’ shares in Māori freehold land are typically expressed as decimal numbers on the record of title, for example:

  • Owner A - 0.33334 share.
  • Owner B - 0.33333 share.
  • Owner C - 0.33333 share.

Landonline converts decimal numbers to fractions

When preparing a transfer instrument, Landonline automatically converts the current owners shares from decimal numbers to fractions.

Where there is no direct conversion, Landonline will convert the decimal number to its nearest fraction. As an example, a 0.33334 share will convert to 1/3 share even though a 0.33334 share is slightly larger than a 1/3 share. This then has to be reverted to the correct decimal share in accordance with the registered ownership shown on the title.

LINZ is considering an enhancement so that Landonline will leave the shares expressed in the transfer instrument as decimals, but until that is introduced the following workaround is required.

Preparing a transfer of a share

When preparing a transfer of a person’s share in Māori freehold land, it is important that the transfer instrument reflects the share that is being dealt with in decimal numbers, as the share is shown on the record of title. To do so:

  1. Prepare the transfer in Complex mode.
  2. Add text to the Additional Clauses, Conditions or Intent field to state correctly the share being dealt with, in decimal numbers.
  3. Save the page to view the Resulting Ownership in the Summary tab and confirm you have set up the Transfer correctly.

The dealing will step down to Lodge, and LINZ will record the shares in decimal numbers.

Note that transfers of shares in Māori freehold land must comply with Māori Land Court confirmation requirements as provided in Te Ture Whenua Māori Act 1993:
