Notice of Change requirements by instrument type

Use this page to check whether a Notice of Change (NoC) is mandatory or recommended for different instrument types and ownership change scenarios.

When a Notice of Change is mandatory

You must complete a Notice of Change (NoC) for:

  • Transfer (T): Sale and purchase transactions involving a market sale. For Transfer transactions other than market sales, see:

  • Transfer Power of Sale (TPS): Mortgagee sales. 

When a Notice of Change is recommended

For the following instruments and situations, a NoC is optional. However, it is still the recommended way to notify the council of a change of ownership.

  • Transfer (T): Transactions other than market sales, including:

    • gifts
    • changes of trustees
    • vesting under legislation or a court order
    • relationship property settlements
    • administration of estates.

    These transactions do not require you to complete any additional fields.
     

  • Change or Correction of Name (CN): A transaction involving a change or correction of name.
     
  • Transmission (TSM): A transmission transaction.
     
  • Application under section 90 of the Land Transfer Act 2017 (A90): An application to update a record of title when land or an interest in land is vested in a person or organisation by statute. This application is a special type of transmission.
     
  • Court Order (CO): A court-ordered change of ownership. 
    You do not need to complete a NoC if the court order does not involve a change of ownership. 

Post Registration Notice of Change (PRNoC) scenarios

PRNoC scenarios have not changed. If you currently complete a PRNoC for an instrument or scenario, continue to follow the existing process.
