Tax statements are required when most land is transferred

People buying, selling or transferring property must provide tax information using a land transfer tax statement. 

A separate statement is required from every seller (transferor) and buyer (transferee).

Some exceptions apply, for example the transfer of Māori land.

Information in the land transfer tax statement is usually sent to Toitū Te Whenua by the lawyer or conveyancer who is acting on behalf of the transferor or transferee. We collect the information on behalf of Inland Revenue (IR) so they can make sure property tax obligations are met.

Completing a land transfer tax statement

When completing the statement, you must provide information about whether:

  • the land being transferred has a home on it
  • the transfer is going to be land with a main home on it
  • you or a member of your immediate family is a New Zealand citizen, or holds a Permanent Resident, working or Student Visa
  • the transfer is non-notifiable. 

Non-notifiable reasons are prescribed in regulations. Unless the transfer is non-notifiable, you must provide an IRD number and information about whether you are a tax resident in another country.

Tax statements for dealings completed in Landonline

You don't need to send tax statements to Toitū Te Whenua if a dealing is completed fully in Landonline. Your lawyer will enter the information from your completed tax statement into Landonline.

The original copies should be held by your lawyer for 10 years.

Tax statements for manual dealings

For manual dealings, tax statements must be sent to Toitū Te Whenua with the transfer documents and manual dealing lodgement form. Either you or your lawyer will do this.

Toitū Te Whenua will enter the tax statement into Landonline.
