Add existing easements to be retained or surrendered in the Schedule / memorandum panel

How to record existing easements to be retained or existing easements to be surrendered in the Schedule / memorandum panel.

In our example, we are populating 1 row in a Schedule of existing easements. The process is similar for:

  • Schedule of existing easements in gross
  • Schedule of existing easements to be surrendered
  • Schedule of existing appurtenant easements.

We have noted any differences within the relevant section.

1. Capture all parcels

Ensure all relevant parcels under survey have been captured in the Existing parcels and New parcels panels.

2. Add estate records

Add the correct Record of Title(s) to the Estate records tab in the Existing parcels panel.  

This enables tables created in the Schedule / memorandum panel to recognise any instruments recorded against the Record of Title(s).

3. Create existing easement table

Open the Schedule / Memorandum panel and select +Create table

Select the appropriate existing easement table type from the drop-down list. For this example we will select Schedule of existing easements.

Populating the table

In this guidance we have chosen to populate the table fields left-to-right, adding the Purpose first. You can complete the fields in any order, for example, you may choose to start by selecting Creating document.

4. Add purpose

Double-click into the Purpose field and select the existing easement’s purpose(s) from the list. You can select:

  • more than 1 purpose where applicable
  • Other to enter a purpose that is not in the list.

Press Tab or Enter on your keyboard, or click outside the Purpose dropdown, to populate your selection into the Purpose field.

You can view the Purpose of existing easement instruments by double-clicking in the Creating Document field. This displays a list of instruments recorded against any Record of Title(s) captured in the Estate records tab.

5. Select shown

For the Shown field, you can:

  • select an appellation from a list of Created parcels and Referenced or Extinguished Non-primary parcels in the survey
  • enter an appellation via free text, for parcels not listed
  • spatially select a linked created parcel.

Option 1: Select an appellation from a list of Created parcels and Referenced or Extinguished non-primary parcels in the survey

Double-click into the Shown field and select the appellation from the list. You can type to filter the list if there are a large number of appellations listed.

Press Tab or Enter on your keyboard, or click outside the Shown dropdown, to populate your selection into the Shown field.

Note: If you have linked all your parcels, the Burdened land will automatically populate from your selected Shown.

Option 2: Enter an appellation via free text

If the appellation you need is not listed, you can enter the appellation via free text. For example, when completing a Schedule of existing easements to be surrendered, you can enter the previous parcel appellation.

Double-click into the Shown field and type the previous appellation into the free text field.

Press Enter on your keyboard to add the appellation to the list.

The appellation is automatically selected in the list.

Note: A free-text appellation will not be:

  • saved if you deselect it and continue
  • retained through remaining rows in the table.

Press Tab or Enter on your keyboard, or click outside the Shown dropdown, to populate your selection into the Shown field.

Option 3: Spatially select a linked created parcel

Select the Parcel picker tool that appears when you hover your mouse over the Shown field.

The screen switches to Select parcel mode. All linked parcels are displayed with red outlines.

Left-click a spatial parcel to add it to Shown easement parcels at the bottom right of your screen. Any selected parcels also display pink on screen.

Select Continue to populate your selection into the Shown field. The Burdened land will also automatically populate from your selected Shown.

6. Select burdened land

You can select the burdened land from a list of captured primary parcels in your survey.

  • For existing easements to be retained:
    • you can select from captured Created, Referenced, and Affected primary parcels
    • this field is automatically populated from Shown if your parcels are linked and the Shown appellation is a created parcel in your survey
  • For existing easements to be surrendered:
    • you can select from captured Extinguished, Referenced, and Affected primary parcels
    • this field is automatically populated once you select Shown, if there is only 1 existing primary parcel captured in the survey.

Double-click into the Burdened land field and select an appellation from the list.

Press Tab or Enter on your keyboard, or click outside the Burdened land dropdown to populate your selection into the Burdened land field.

You will see an orange warning triangle if shown and burdened parcels are not valid together, or you have not completed a required field. Hover your mouse over a warning triangle to see the issue.

Any orange warning triangles must be resolved before the Schedule / memorandum is attached as a supporting document.

Use parcel picker tool to select burdened land

You can also use the Parcel picker tool to spatially select burdened land.

You can’t spatially select extinguished parcels once you have linked your new parcels.

Left-click a spatial parcel to add it to Burdened easement parcels at the bottom right of your screen. Any selected parcels also display pink on screen. Select Continue to populate your selection into the Burdened land field.

7. Select creating document

Double-click into the Creating document field.

A popup window of instruments recorded against any Record of Title(s) captured in the Estate records tab is displayed at the right of the panel.

Use your mouse or the scroll bar on the right-hand side of the panel to scroll through the instruments to find the easement rights that are to be retained or surrendered. To view more detail about an instrument:

  • Select show more to expand text or show less to collapse text.

  • Select an Instrument number or Title reference to open Landonline Web Search in a new browser tab. The summary page for the selected record will display.

Select the Add instrument to table button (the Plus icon) to add an instrument as the creating document.

To change the creating document, double-click back into the field and select a different instrument.

8. Add further Purposes and Rows to the table as needed

Select:

  • +Add new row to add a new row with the same purpose as the previous row to the current table
  • +Add new purpose to add a new row with a different purpose to the current table.
